SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL/TLS encryption. 4. Data collection on this website

Cookies

Our internet pages use so-called "cookies". Cookies are small data packets and do not cause any damage to your terminal device. They are stored on your terminal device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to analyse user behaviour or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions desired by you (e.g. for the shopping cart function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. Insofar as consent to the storage of cookies and comparable recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be restricted.

You can find out which cookies and services are used on this website in this privacy policy.

CookieFirst

Our website uses CookieFirst to obtain your consent to the storage of certain cookies on your terminal device or to the use of certain technologies and to document this in a manner compliant with data protection law. The provider of this technology is Digital Data Solutions B.V. (CookieFirst), Plantage Middenlaan 42A, 1018 DH Amsterdam, Netherlands (hereinafter "CookieFirst").

When you enter our website, a connection is established to the servers of CookieFirst in order to obtain your consents and other declarations regarding the use of cookies. CookieFirst then stores a cookie in your browser in order to be able to assign the consents you have given or their revocation to you. In doing so, the IP address (anonymised), the user agent of the browser and operating system and the URL from which the consent was given are processed and integrated into CookieFirst. The data collected in this way is stored until you request us to delete it, delete the CookieFirst cookie yourself or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

CookieFirst transfers personal data to third-party providers. These include a CDN from Slovenia, IP geolocation from Romania and hosting with OHV in Germany and France. CookieFirst has its company headquarters in Amsterdam, Netherlands.

CookieFirst is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1)(1)(c) GDPR.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law which ensures that this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website, and for this purpose the server log files must be collected.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR, insofar as your enquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) insofar as this has been requested.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

Enquiry by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request.

The data you send us via contact enquiries will remain with us until you request us to delete it, revoke your consent to storage or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

Postmark

For sending necessary messages (contact form, barbecue areas, etc.), we use the product "Postmark" from the company ActiveCampaign, LLC, 1 N Dearborn Street, 5th Floor, Chicago, IL 60602, USA.

Postmark is a service that can be used, among other things, to organise and analyse the sending of emails and newsletters. If you provide data such as an email address and we send an email to this email address, this data is stored on the servers of Postmark in the USA. We use Postmark exclusively for sending emails.

Postmark/ActiveCampaign has a certification under the "EU-US Privacy Shield". The "Privacy Shield" is an agreement between the European Union (EU) and the USA that is intended to ensure compliance with European data protection standards in the USA: https://www.privacyshield.gov/participant?id=a2zt0000000GnH6AAK.

5. Analytics tools and advertising

Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The Google Tag Manager is a tool with which we can integrate tracking or statistics tools and other technologies on our website. The Google Tag Manager itself does not create user profiles, does not store any cookies and does not carry out any independent analyses. It merely serves to manage and deliver the tools integrated via it. However, the Google Tag Manager collects your IP address, which may also be transferred to Google's parent company in the United States.

The Google Tag Manager is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the fast and uncomplicated integration and management of various tools on its website. Where corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

The company has a certification under the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA that is intended to ensure compliance with European data protection standards in the case of data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. You can obtain further information on this from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and origin of the user. This data is assigned to the respective terminal device of the user. It is not assigned to a user ID.

Furthermore, with Google Analytics we can, among other things, record your mouse and scroll movements and clicks. In addition, Google Analytics uses various modelling approaches to supplement the collected data sets and uses machine learning technologies in the data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transferred to a Google server in the USA and stored there.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. You can find details here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address is shortened by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with further services associated with website and internet use. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

More information on how Google Analytics handles user data can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Data processing agreement

We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Meta Pixel (formerly Facebook Pixel)

This website uses the Meta visitor action pixel for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Meta, however, the data collected is also transferred to the USA and other third countries.

This makes it possible to track the behaviour of site visitors after they have been redirected to the provider's website by clicking on a Meta advertisement. This makes it possible to evaluate the effectiveness of the Meta advertisements for statistical and market research purposes and to optimise future advertising measures.

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Meta, so that a connection to the respective user profile on Facebook or Instagram is possible and Meta can use the data for its own advertising purposes, in accordance with the Meta data usage policy (https://de-de.facebook.com/about/privacy/). This enables Meta to place advertisements on Facebook or Instagram pages and other advertising channels. This use of the data cannot be influenced by us as the site operator.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be revoked at any time.

We use the advanced matching function within the Meta Pixel.

Advanced matching enables us to transmit various types of data (e.g. place of residence, federal state, postal code, hashed email addresses, names, gender, date of birth or telephone number) of our customers and prospective customers that we collect via our website to Meta. This allows us to tailor our advertising campaigns on Facebook and Instagram even more precisely to people who are interested in our offerings. In addition, advanced matching improves the assignment of website conversions and expands custom audiences.

Insofar as personal data is collected on our website and forwarded to Meta with the help of the tool described here, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its transfer to Meta. The processing carried out by Meta after the transfer is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. You can find the wording of the agreement at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Meta tool and for the data protection compliant implementation of the tool on our website. Meta is responsible for the data security of the Meta products. You can assert data subject rights (e.g. requests for information) with regard to the data processed on Facebook or Instagram directly with Meta. If you assert the data subject rights with us, we are obliged to forward them to Meta.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. You can find details here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

You can find further information on the protection of your privacy in Meta's privacy notices: https://de-de.facebook.com/about/privacy/.

You can also deactivate the remarketing function "Custom Audiences" in the advertising settings area at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do this, you must be logged in to Facebook.

If you do not have a Facebook or Instagram account, you can deactivate usage-based advertising from Meta on the website of the European Interactive Digital Advertising Alliance: https://www.youronlinechoices.com/de/praferenzmanagement/.

You can obtain further information on this from the provider at the following link: https://www.dataprivacyframework.gov/participant/4452.

Meta Conversion API

We have integrated the Meta Conversion API on this website. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Meta, however, the data collected is also transferred to the USA and other third countries.

The Meta Conversion API enables us to record the interactions of the website visitor with our website and to pass them on to Meta in order to improve advertising performance on Facebook and Instagram.

For this purpose, in particular the time of the access, the accessed website, your IP address and your user agent as well as, where applicable, further specific data (e.g. purchased products, value of the shopping cart and currency) are recorded. You can find a complete overview of the data that can be recorded here: https://developers.facebook.com/docs/marketing-api/conversions-api/parameters.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be revoked at any time.

You can also deactivate the remarketing function "Custom Audiences" in the advertising settings area at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do this, you must be logged in to Facebook.

If you do not have a Facebook or Instagram account, you can deactivate usage-based advertising from Meta on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

You can obtain further information on this from the provider at the following link: https://www.dataprivacyframework.gov/participant/4452.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law which ensures that this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. Further data is not collected or is collected only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is carried out exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke the consent you have given to the storage of the data, the email address and its use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The lawfulness of the data processing operations already carried out remains unaffected by the revocation.

The data you provide to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter or after the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6(1)(f) GDPR.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist in order to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

7. Visitor survey and prize draw

Visitor survey

On our website, at https://www.kurpfalz-park.de/umfrage we offer you the opportunity to take part in a visitor survey. The answering of the survey questions is anonymous; we do not collect any data that allows the identification of your person.

For technical reasons (protection against spam and automated multiple participations), when submitting the survey we process your IP address in pseudonymised form (hashed value). This pseudonymised data is used exclusively to limit the number of participations per person per day and is automatically deleted after 30 days at the latest.

In addition, anti-spam mechanisms (so-called honeypot fields) are used, which detect without further data processing whether the form was filled out by an automated bot.

The legal basis for this processing is Art. 6(1)(f) GDPR (legitimate interest). Our legitimate interest lies in improving our offering on the basis of visitor feedback and in protecting the form against misuse.

Prize draw

Following the visitor survey, you have the option of voluntarily taking part in a prize draw. For this purpose, we collect the following personal data:

  • First name
  • Surname
  • Email address

This data is used exclusively for the purpose of carrying out the prize draw, that is, for the monthly draw of the winners, the notification of the winners by email and the sending of the tickets won. It is not passed on to third parties for advertising or other purposes.

The legal basis for the processing is Art. 6(1)(b) GDPR (performance of a contractual relationship, here: participation in the prize draw in accordance with the terms of participation). The data of the participants is automatically deleted no later than 90 days after the respective draw, unless statutory retention obligations prevent this.

Google Web Fonts (local hosting)

For the uniform display of fonts, this site uses so-called web fonts provided by Google. The Google Fonts are installed locally. A connection to Google servers does not take place in the process.

Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy?hl=de.

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland. With the help of this service, we can embed map material on our website.

To use the functions of Google Maps, it is necessary to store your IP address. This information is generally transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. When Google Maps is activated, Google may use Google Fonts for the purpose of the uniform display of the fonts. When you call up Google Maps, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly.

Google Maps is used in the interest of an appealing presentation of our online offerings and to make it easy to find the places we have indicated on the website. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. You can find details here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

More information on the handling of user data can be found in Google's privacy policy: https://policies.google.com/privacy?hl=de.

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by email, by post or via an online application form). In the following, we inform you about the scope, purpose and use of your personal data collected in the course of the application process. We assure you that the collection, processing and use of your data is carried out in accordance with applicable data protection law and all other statutory provisions and that your data is treated strictly confidentially.

Scope and purpose of the data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.), insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG-neu (German Federal Data Protection Act) under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation) and, insofar as you have given consent, Art. 6(1)(a) GDPR. Consent can be revoked at any time. Your personal data is passed on within our company exclusively to persons who are involved in processing your application.

If the application is successful, the data you submit is stored in our data processing systems on the basis of Section 26 BDSG-neu and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

Retention period of the data

If we cannot make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have transmitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). The data is then deleted and the physical application documents are destroyed. The retention serves in particular for evidence purposes in the event of a legal dispute. If it is apparent that the data will be required after the expiry of the 6-month period (e.g. due to an imminent or pending legal dispute), deletion only takes place when the purpose for the further retention no longer applies.

Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you a job offer, there may be the possibility of including you in our applicant pool. In the event of inclusion, all documents and information from the application are transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6(1)(a) GDPR). The giving of consent is voluntary and has no relation to the ongoing application procedure. The data subject can revoke their consent at any time. In this case, the data is irrevocably deleted from the applicant pool, provided there are no statutory reasons for retention.

The data from the applicant pool is irrevocably deleted no later than two years after consent has been given.
